1. Data Types and General Guidelines

  • Anonymous dataThe term “Anonymous Data” means data that is not associated with or linked to your Personal Data. By itself, Anonymous Data does not identify individuals. Personal Data and Anonymous Data are collected as described below. Lulu collects and uses Personal and Anonymous Information about you to (i) provide, measure and improve the Services, (ii) communicate with you about your Account (as defined below) or your transactions, ( iii) send information about any changes we make to the Services or our policies, (iv) send offers and promotions to you, (v) personalize content in the Services for you, (vi) detect,

2. How we obtain information

  • Information You ProvideYou do not need to provide Personal Information to use the Site. However, you may be required to provide some Personal Information to use some of our Services, such as when you create a user account (an “Account”). When you create or update an Account, you must provide Personal Information so that Bradnotes can contact you and send you items purchased through Paid Professional Services, and when you place an order, we will collect financial information, such as your bank account number. and/or your credit card number so that we or our third party service providers can process payments (“Financial Information”). Bradnotes will store and use all such information in accordance with this Warranty. Furthermore,
    • If you provide location information (for example, by allowing your mobile device to send Bradnotes your location), we may store and use that information to provide you with location-based information. This feature can be turned off in your device’s location settings.
    • After creating an account, our Site allows you to store preferences such as how you want to view content, location and safe search settings. As fully described in the Terms and Conditions , Bradnotes may associate these choices with your ID, browser or mobile device.
    • We hold information on your behalf, such as content you submit through the Services in connection with an order, content creation, or content distribution.
    • If you submit feedback or contact us by email, we may collect your name and email address and any other content included in the email in order to respond.
    • If we provide the ability to post messages on the Site (for example, in a forum), the information you post will be stored on Lulu’s servers for other users to view.
    • We also collect other types of Personal Data that you voluntarily provide in connection with supporting the Services, such as your operating system and version, and type of mobile device or computer.
    • If you enter a survey, contest or giveaway on our Site, we may ask you for your email address and/or telephone number (to let you know the outcome of the contest). We may also ask for your first and last name and, sometimes, postal addresses to verify your identity or send your prizes. Participation in these contests or surveys is voluntary and the user is required to read the regulations of each initiative before accessing them.
    • We may also collect Personal Data at other times during your use of our Site or Services where it is indicated that Personal Data will be collected.
  • Information collected through the use of technologiesWe use standard online and mobile technologies to provide and improve the Services, and in some cases, these technologies may ask you for additional information:
    • Information collected by our servers.To make the Site and our Services more useful to you, our servers (which may be hosted by a third-party service provider) collect information about you, including your browser type, operating system, address IP (a number that is automatically assigned to the user’s computer when using the Internet and which varies from session to session), the domain name and/or the date/time of the visit.
    • Log files.Like most websites, we collect some data automatically and store it in the log file. This information includes IP addresses, browser type, ISP, login/exit pages, operating system, date/time stamp, and clickstream data. Bradnotes uses this information to analyze trends, operate the Services, monitor users’ movements around the Site, gather demographic information about the user base as a whole, and to better customize the Services based on users’ needs. For example, some of the information could be collected so that the Site or the Services recognize the user at each visit. This information will then be used to provide more appropriate information based on your interests. Except as stated in this Warranty,
    • Cookies.“Cookies” are small pieces of information that a website sends to your computer’s hard drive when you view the website. We may use both session cookies (which expire once you close your web browser) and persistent cookies ( that remain on your computer until you delete them) to provide you with a more personal and interactive experience of the Services.
    • Pixel Tags.We also use “Pixel tags” (also called clear GIFs, web beacons or web bugs). Pixel tags are small graphic images with a unique identifier. They work similar to cookies and are used to track web users’ online movements. Unlike cookies, pixel tags are embedded invisibly into web pages and are not saved on a user’s computer. In addition, Pixel Tags allow us to send email messages in a user-readable format and tell us whether emails have been opened to ensure that we only send messages that are of interest to our users. We do not attach the information collected by Pixel Tags to our users’ Personal Data.
    • Flash LSOs.When we publish videos, third parties may use Local Shared Objects, also known as “Flash cookies” to store user preferences for volume control or to customize some video features. Flash cookies differ from browser cookies in the amount and type of data and in the way the data is stored. The cookie management tools provided by your browser do not remove Flash cookies.
    • How we respond to Do Not Track signals.Users can use Bradnotes’s privacy settings tool to customize the amount of data Bradnotes is permitted to collect when you access the Bradnotes Site or Services.
    • Analysis services.Other companies may eventually place their own cookies or similar tools when you visit our Site or use the related Services. This includes third-party analytics services that we partner with to analyze how users use the Services. Bradnotes may receive reports based on the use of these tools from these parties, on an individual or aggerated basis. The information obtained from the Analysis Services is used only to improve the Site and the Services. The information generated by Cookies or other technologies about your use of our Site and our Services (the “Analytics Information”) is transmitted to the Analysis Services, which use it to create reports on user activity. The Analytics Services may also transfer information to third parties where required to do so by law or where such third parties process the information on their behalf.   • Information Collected by Third PartiesBradnotes may receive Personal Information and/or Anonymous User Information from companies that provide our Services through a jointly or individually branded Site, or companies that offer their own products and/or services on our Site. We may add this information to that already collected about you as described in this Guarantee to improve the Services

3. Use and Disclosure of Personal Data

  • General indicationsThe Personal Data you submit to Bradnotes is typically used to provide the Services, respond to requests made by you or your customers, or to provide better service to you and your customers. We use your Personal Data in the following ways:
    • to facilitate the creation of the Account and to protect it;
    • to identify you in our system;
    • to provide improved management of our Site and Services;
    • to provide the Services you request;
    • to improve the quality of the experience when the user interacts with the Site and the Services;
    • to send you a welcome email and verify ownership of the email address you provided when creating your Account;
    • to send you administrative email notifications, such as security or support email notifications and maintenance alerts, as well as order and shipping confirmations;
    • to send newsletters, surveys, offers, and other promotional materials related to our Services.
  • Testimonials and user feedback. Forums
    • We often receive testimonials and comments from users who have had positive experiences with our Services. We sometimes publish this content. When we do this, we may identify our users by first and last name and indicate the city of origin, but before publishing this information together with the testimonial we ask for the user’s consent. We may post a user’s feedback with first and last initials or an Account handle that does not identify the user, without prior approval. When you provide Feedback in connection with the Services, you allow Bradnotes to use that Feedback and identify you, as described in this section.
    • If you comment on a blog or forum associated with our Site, you should be aware that any Personal Data you submit may be read, collected or used by other forum users and may be used to send unwanted messages. Even if you delete this information later, it may have been saved by other users on their computers, and deleting the post would not affect any other existing copies of that information. We are not responsible for the Personal Data you choose to submit in blogs and forums.
  • Creating Anonymous Data.
    • We may create Anonymous Data records from Personal Data by excluding information that can identify you. We use this Anonymous Data to analyze requests and usage patterns so that we can improve the Services and Site navigation. Bradnotes may use the Anonymous Data, aggregate information, or other non-personal information for any purpose and disclose the Anonymous Data to third parties at its sole discretion.
  • Disclosure of Personal Data.
    • Third Party Service Providers.Bradnotes may share your Personal Data with third party service providers so that they can: provide you with Services offered through the Site; conduct quality control tests; facilitate the creation of Accounts; provide technical support; and/or provide other services to Bradnotes. Third-party service providers are required to use your Personal Data only to provide the services requested by Bradnotes.
    • Affiliates.Bradnotes may share some or all of your Personal Data with its parent companies, subsidiaries, joint ventures or other companies under common control (“Affiliates”); in such event, Affiliates are required to comply with this Guarantee. Corporate restructuring. Bradnotes may share all or any portion of your Personal Data in the event of a merger, acquisition, dissolution or proceeding involving the sale, transfer, assignment or disclosure of all or a portion of its businesses and its resources. In the event of an insolvency, bankruptcy or receivership, Personal Data may also be transferred as a business asset. If the company, business or assets are acquired by another company,
    • Other supplemental information. Regardless of any choices you make with respect to Personal Information (as described below), Bradnotes may disclose it if you have a good faith belief that such disclosure is necessary to (i) conduct a legal investigation; (ii) to comply with applicable laws or to respond to warranty notices or warrants received from the Company; (iii) to protect or defend the rights or property of the Company or users of the Site or Services; and/or (iv) to investigate or prevent violations or potential violations of the law, this Privacy Policy or our  Terms and Conditions .

4. Protection of User Content

Bradnotes intends to provide you with the ability to control who can access the Content and any associated information stored in your Lulu account. Bradnotes attempts not to make User Content publicly accessible, unless you explicitly do so or as otherwise set forth in this Privacy Policy (in Section 3 of this Privacy Policy).

In order to provide quality products, Bradnotes employees and third-party service providers who fulfill orders or provide customer support may need to access your User Content.

5. Update of personal data

Bradnotes is committed to keeping all of your Personal Data up to date as you provide it. Bradnotes allows you to update your account information and change your password at any time. Simply go to your Account Profile pages on the Site to make such changes or contact the Customer Service team under ‘Support’ on the Site. If there is a change to your Personal Data or there is an error in our records, please contact Bradnotes who will update the data.

6. Third Party Websites

The Site and the Services may contain links to third-party websites. Links to third party websites or locations are provided for convenience only and do not represent an endorsement by Bradnotes of such third parties or their products, content or websites. When you click a link to a another website, leave our Site or our Services to access another Site and another entity may collect your Personal Data. We have no control over these sites, do not review and cannot be held responsible for any external websites, their content or practices. This Guarantee does not apply to external websites. We encourage the user to read the privacy guarantees of each website visited.

7. Your Choices About Information.

There are several choices available to you regarding the use of information in connection with our Services:

  • Email communications.  From time to time Bradnotes may send newsletters and emails to promote the Site or the Services. When you receive newsletters or promotional communications from Bradnotes, you may opt-out of receiving further communications and have the option to opt-out by following the unsubscribe instructions in the email you received or by updating your preferences on your Account Profile pages. of the Site.   • Changing or Deleting Personal Data.  All users can check, update, correct or delete the Personal Data in their Account from the “My Account” page in the Services. If you completely delete all Personal Data, your Account may be deactivated. Bradnotes may maintain a copy of your records on file as required by law or for legitimate business purposes.

8. Data Security and Integrity

The security, integrity and confidentiality of your information is extremely important to Bradnotes. We employ physical, electronic and organizational procedures and security measures to protect your Personal Data. However, there is always some risk in transmitting data electronically. The Personal Data collected is stored in databases under our control. To protect this information, we use industry-standard security measures, such as firewalls and encryption technology. However, we cannot guarantee the security of our databases or that the information you provide will not be intercepted during data transmission over the Internet.

  • Request for personal data and CCPA complianceCalifornia law, under the California Consumer Protection Act (CCPA), permits users who are California residents to request a summary of the personal information we have collected during the previous 12 months. This includes personal data used for your account, security data, sales and revenue data, and information Bradnotes provides to third-party service providers, as described elsewhere in this privacy policy. Bradnotes never sells your information, although we may share it for specific marketing purposes through our third party vendors. You may request that we not share your information with third party service providers at any time by contacting us at the address set out below. Bradnotes will provide Personal Data and/or remove your Personal Data upon verified request. To request a summary of your personal data or the removal of your personal data, please contact us.

9. Our Policy Regarding Children

The Service is not intended for use by children under the age of 16. Whenever you become aware that Bradnotes may have Personal Information about a child, please write to us . We do not knowingly collect Personal Data from children under the age of 16. If we become aware that a child under 16 has provided us with personal information, we will take steps to remove that information and close the associated Account. You may not register on the Bradnotes Service if you are under the age of 16. If you wish to use the Bradnotes Site or Services and you are under the age of 16, a legal guardian will need to create a Bradnotes Account and register for the Services.

10. Changes to this Warranty

This Guarantee is subject to occasional revisions, and if we make material changes to the use of Personal Data, we will email you at the most recent email address you provide and/or post a prominent notice of the changes on the Site. Any changes made to this Guarantee will be effective on the earlier of thirty (30) calendar days from the sending of the e-mail notification to the user and thirty (30) calendar days from the publication of the notice relating to the changes on the Site. Such changes will be effective immediately for new users of our Services.

At all times, you are responsible for updating the Personal Data you provide with the most recent email address. In the event that the email address last provided to Bradnotes is invalid, or for any reason Bradnotes is unable to deliver the above notice, Bradnotes’s mere sending of the email containing the notice the aforementioned constitutes in any case effective communication of the changes described therein. If you do not wish to consent to the changes to the use of your Personal Data, you must deactivate your Account prior to the effective date of such changes.

11. Jurisdiction

The Site is controlled and operated by Bradnotes in the United States of America and the company is not subject to the laws or jurisdiction of any country or territory outside the United States. Bradnotes makes no representations or warranties that the Site or any part thereof is suitable or available in any particular jurisdiction. By choosing to access the Site, you are acting on your own initiative, as well as at your own risk and assume responsibility for compliance with all local laws, rules and regulations. Bradnotes reserves the right to restrict access to the Site in whole or in part for any user, country or jurisdiction, at any time, in its sole discretion.
